Okla. GOP leaders blast decision on health care

OKLAHOMA CITY (AP) ? Republican leaders in Oklahoma were quick to criticize the U.S. Supreme Court?s decision Thursday to uphold the federal health care law but offered no specifics on how they intend to proceed with implementing its provisions.

Gov. Mary Fallin said she was working with her legal team and state agencies to determine what the implications are for Oklahoma, but that she has no plans to call a special session to address some of the law?s requirements that lawmakers decided not to enact.

After the nation?s highest court upheld most of President Barack Obama?s historic health care overhaul in a 5-4 decision, Fallin told reporters she was still trying to digest the ruling.

?We want to make sure we get it right ? and take the appropriate amount of time to do our legal research, certainly listen to the experts in the industry to help us be able to determine what are the options to the state of Oklahoma,? Fallin said.

Like many other GOP-controlled legislatures, Oklahoma resisted setting up new online insurance marketplaces ? or exchanges ? where people can shop for and buy health insurance, a linchpin of the federal legislation. Instead, those states have opted to gamble that the law would be struck down.

Opposition to the health care law was so fierce in Oklahoma that the Legislature rejected $54 million in federal money to help set up the exchange, mostly because of resistance from tea party activists and other conservatives who maintained the plan would inextricably link the state to new federal requirements.

Because Oklahoma, like many other states, took no action to create an exchange, experts say it?s unlikely the state has time to develop one that would meet federal deadlines.

?One of the things (Thursday?s ruling) means is that the health insurance or health benefit exchange, we will probably have the federal model forced on us, because the Legislature is out of session and can?t implement the Oklahoma version of the exchange,? said Kevin Gordon, president of Crowe & Dunlevy and the head of the Oklahoma City law firm?s health care litigation practice group.

Gordon called it unlikely that Oklahoma could establish an exchange by January.

Fallin defended the state?s decision not to implement some of the federal law?s requirements, saying Oklahoma voters sent a clear message to state leaders in November 2010 when they voted by a nearly 65 percent margin for a constitutional amendment prohibiting the forced participation in a health care system.

?I think the people of Oklahoma spoke very clearly in November when they said they didn?t believe the federal health care bill was the right solution for the state of Oklahoma, so we listened to the people,? Fallin said.

Gordon said Thursday?s ruling essentially makes that constitutional change null and void because of the supremacy clause in the U.S. Constitution that says federal law supersedes state law.

About 17 percent of Oklahomans, or nearly 625,000 people, are currently uninsured, according to the latest figures from the Oklahoma Health Care Authority. About 81 percent of those are adults over the age of 18.

The expansion of Medicaid eligibility to up to 133 percent of the federal poverty level that was included in the federal law was estimated to cut that number of uninsured nearly in half, by about 250,000, according to OHCA estimates. But the court in its ruling determined that Congress? ability to punish states that don?t comply with the Medicaid expansion was limited.

?The way we?ve read it, it looks like the court is giving states the choice,? said Jo Kilgore, a spokeswoman for the Health Care Authority.

Oklahoma currently provides Medicaid coverage for children, pregnant women and women with breast and cervical cancer with a household income of up to 185 percent of the poverty level. But for adults, the current eligibility is 37 percent of the federal poverty level.

Fallin spokesman Alex Weintz said the governor was not prepared to discuss her position on the expansion of Medicaid eligibility.

Pelosi on Holder vote: What GOP is doing is 'contemptible, even for them'

House Minority Leader Nancy Pelosi (D-Calif.) said she would join members of the Congressional Black Caucus (CBC) when they walk out of the vote on the resolution finding Attorney General Eric Holder in contempt of Congress.

Pelosi initially said she preferred to vote against the resolution, but said she has been moved by the CBC plan to walk out later today.

"Perhaps that's the best approach for us to take," she said on the House floor. "How else can we impress upon the American people without scaring them about what is happening here?"

Later in her remarks, she told her Democratic colleagues to do as they see fit, a sign that many more Democrats could walk out when the House votes.

"So now I say to those who have a doubt about how they want to proceed, that instead of doing what I said before ? which was just to come and to treat this as a bill before the Congress and express my no ? listening to the unconscionable presentation, I want to join my CBC colleagues in boycotting the vote when we have the walkout after we have the debate," she said.

Pelosi earlier said the Republicans' attack on Holder for his role in the Fast and Furious gun-walking program is a politically motivated move ?based on a false premise,? and she vowed to leave the chamber floor if the rest of her caucus did the same.

?There's an attitude in our caucus that we should not honor the process,? Pelosi said during her weekly press briefing in the Capitol. ?I myself intend to stay long enough to vote 'no,' and ? many in the Caucus think that we should do a complete walk-off. I honor the wish of my Caucus.?

As many as 120 Democrats may walk out in opposition to Thursday?s contempt vote on Holder, according to one lawmaker.

Rep. Raul Grivalva (D-Ariz.) told The Hill that he expects ?over 120 Democrats? to protest the unprecedented Republican-led vote by staging a walkout and holding a press conference on the East front of the Capitol.

Democrats have been trying to drum up support for the walkout, holding a caucus meeting Thursday morning where members handed out copies of a recent investigative story in Fortune that refuted allegations of ?gun-walking? in the botched Fast and Furious operation that is at the center of the contempt measure.

Several Democrats have said they will buck party lines and support the contempt resolutions, in the wake of the National Rifle Association?s (NRA) decision to score the vote.

At least four Democrats in GOP-leaning districts ? Reps. Collin Peterson (D-Minn.), Nick Rahall (D-W.Va.), Jim Matheson (D-Utah) and John Barrow (D-Ga.) ? have pledged their support for the contempt measure.

Rep. Jason Altmire (D-Penn.) told The Hill in an interview before Thursday?s vote that he was still undecided about how he was planning to vote.

Altmire pointed to his support of a Democratic-led contempt measure in 2008 of two senior White House officials in President George W. Bush?s administration, and said that he was trying to find out why he wouldn?t hold the Obama administration in contempt for similarly refusing to respond to a congressional subpoena.

More than a dozen Democrats voted in favor of a rule governing floor debate for the civil and criminal contempt resolutions. The rule was approved by every Republican as well in a vote of 254-173 in its favor.

The Democratic support is key for Republicans as they try to defend the legitimacy of the contempt measure to voters and parry counterattacks from Democrats stating that they are leading a ?witch hunt.?

The proposed Democratic walkout is reminiscent of a similar move made by Republicans in 2008 during a Democratic-led vote on whether to hold two senior staffers in President George W. Bush?s administration in contempt of Congress.

House Speaker John Boehner (R-Ohio) ? then the minority leader ? led the walkout with Rep. Darrell Issa (R-Calif.) following closely behind him. Issa, the chairman of the House Oversight and Government Reform Committee, is the sponsor of the contempt resolution against Holder.

?The House floor is the scene of a partisan, political stunt,? said Boehner at the time. House Democrats have been expressing similar comments about the Holder contempt measure.?

Republicans have brought the contempt resolution against Holder for his response to a long-running investigation into the Fast and Furious operation, a program that sanctioned the sale of firearms to known straw purchasers in order to track those guns to Mexican drug cartels. Law enforcers have lost track of hundreds of the weapons, and a pair of assault weapons linked to the botched sting were recovered at the scene of the murder of a U.S. border patrol agent in late 2010.

Behind Issa, chairman of the House Oversight and Government Reform Committee, Republicans have accused Holder of withholding documents they say are vital to their investigation ? a charge Holder has denied.

The contempt resolution passed through the Oversight panel on a strictly party-line vote last week, and the full House will vote on the measure Thursday evening.

If it passes, as it?s expected to do, it will mark the first time in the history of the country that a sitting cabinet member has been held in contempt of Congress.

Design
Pivothead glasses come in four different frame styles (Aurora, Durango, Moab, and Recon), each with multiple lens choices. Each pair comes with 8GB of onboard storage, letting you record approximately 80 minutes of video. There's no card slot for expansion.

Besides the small lens on the bridge of the glasses, the camera parts are tough to notice if you don't know they're there. The Power button is a small nub behind the bulk of the left temple, on the underside of the arm. A small rocker button on the top of the temple controls recording; pressing the rocker forward turns video on and off, while pressing the rocker backward takes still photos, which can be shot while recording video. The temples are more than a centimeter thick, but they flow into the design of the glasses, and the arms thin out to fit more comfortably around the head, with rubber padding on the inner sides.?

The only other hints that the glasses are actually a video camera are the micro-USB connection behind a small rubber door near the power button and a series of three small LEDs located on the inside of the left temple, just out of your peripheral vision. The LEDs indicate if the glasses are on, recording, charging, or connected to a computer. Pivothead decided to keep the LEDs out of the line of peripheral vision so they wouldn't get in the way of users performing high-risk activities like extreme sports. Unfortunately, the LEDs are very difficult to see in bright light. An audible tone to let you know the glasses are recording would help here.

Since the Pivothead glasses have only three buttons, you need to use either a computer or a smartphone to change recording settings. If you're wearing the Pivothead glasses, you're recording what you're seeing, and that's all there is to it. The GoPro HD Hero2 ($299.99, 4 stars) remains the best choice if you need waterproof, shock-resistant video; the other cameras aren't as resilient.?

Because the sensor and lens are so small, video quality from the Pivothead is closer to a smartphone's camera capabilities than a dedicated camera or camcorder. It can record video at 1080p30, 720p60, or 720p30, and can capture up to 8-megapixel still photos while recording by tapping back on the rocker switch. But even at the highest quality setting, recorded video isn't particularly sharp. The glasses performed admirably indoors in good light, but slightly overexposed the video (above) on a sunny day at Coney Island. Still photos looked surprisingly crisp in my tests, but you'll get better performance from a compact camera with a decent lens and sensor. Audio quality isn't quite as good, and the microphone picked up the sounds of my allergies almost as well as it captured my surroundings.

The glasses offer an impressive 75-degree field of vision with little to no distortion, a boon when similar action cameras go for wide lenses at the expense of having a fisheye effect. Still, this is an action camera, and its ability to shoot 720p video at 60 frames per second makes it useful for sports or other activities that suit themselves to a first-person perspective.

Pivothead's Video Recording Eyewear is one of the most useful takes on the head-mounted camera idea I've seen. By simply moving the camera to the middle of a pair of glasses, it offers a better first-person view than any other action camera we've tested. The glasses I tested are unremarkable looking, and they feel a bit cheap for the price, but if you want to record video as you're seeing it, it's one of the best options available.

'Family Guy' creator Seth MacFarlane donates Carl Sagan's papers to Library of Congress

Seth MacFarlane?said that the papers belonging to the astronomer and popularizer of science Carl Sagan were extremely influential to him, and that they should be accessible to everyone.

Jokes aside, his admiration for Sagan runs deep.

The Library of Congress announced Wednesday that, thanks to MacFarlane's generosity, it has acquired the personal papers of the late scientist and astronomer, who spoke to mass audiences about the mysteries of the universe and the origins of life. While MacFarlane never owned Sagan's papers, he covered the undisclosed costs of donating them to the library.

"All I did was write a check, but it's something that was, to me, worth every penny," MacFarlane told The Associated Press by phone from Los Angeles. "He's a man whose life's work should be accessible to everybody."

MacFarlane ? creator of "Family Guy," ''American Dad!" and "The Cleveland Show" ? met Sagan's widow and collaborator, Ann Druyan, at an event a few years ago that brought together Hollywood screenwriters and directors with scientists. They agreed to collaborate on a follow-up to "Cosmos," Sagan's acclaimed 1980 miniseries, with MacFarlane serving as producer. Astrophysicst Neil deGrasse Tyson will host the series, which is scheduled to begin production this fall.

MacFarlane said he watched "Cosmos" as a child and devoured all of Sagan's books.

"He was an enormous and profound influence in my life," MacFarlane said. "He played an essential role ? some would say the only role at the time ? in bridging the gap between the academic community and the general public."

A planetary astronomer and passionate advocate for science, Sagan contributed to a variety of NASA projects and conducted research on the possibilities of extraterrestrial life. He also studied climate change and the "nuclear winter" that could result from a nuclear war. He died in 1996 at age 62.

The papers ? contained in more than 800 filing-cabinet drawers ? include correspondence with other scientists, drafts of Sagan's academic articles and screenplay drafts for the movie "Contact," which was based on Sagan's novel. Also part of the collection: his grade-school report cards and a drawing he made as a child about the future of space exploration.

Druyan said Sagan would have been thrilled to see his life's work made available to the public.

"He was a citizen scientist," Druyan said by phone from her Ithaca, N.Y., home. "He really believed that science belonged to everyone, all of us. He was a 'small-d' democrat in the truest sense of the word."

The donation is part of a busy week for MacFarlane, whose first live-action film, "Ted," hits theaters Friday. While he's known more for crude humor than his interest in science, he hopes to push for a renewed commitment to space exploration. Although he's a liberal Democrat, he was impressed by Newt Gingrich's recent comments about establishing a colony on the moon.

"In the late '60s, they just assumed that would be a given, that things would continue to progress and that the space program would continue to evolve, and it was a no-brainer that we would have a presence on the moon by 2000," MacFarlane said. "We're so far away from that, and it should be embarrassing."

Case Shiller: Portland Real Estate Prices Up 2 Percent In April ? OPB ...

April's home prices in Portland were up by 2 percent, according to the latest numbers from the Case Shiller Index.?

Portland prices were down .09 percent from a year ago.

Last month, Portland saw a?price drop of 2.8 percent, a new low for the city and perhaps a sign the market had "bottomed out."

Case Shiller is a monthly report on real estate markets around the country.?

None of the cities in the report showed new lows for April.

Prices rose around the country by 1.3 percent in the 10 and 20 composite city indexes, reversing seven consecutive months of declines, according to the report.

Though prices continue dropping, the April report is seen as positive news because numbers are dropping at a slower pace in April than March, the report said.

Ten of 20 markets showed positive annual returns. They were Boston, Charlotte, Dallas, Denver, Detroit, Miami, Minneapolis, Phoenix, Tampa and Washington D.C. Only New York and Detroit fared worse in April.

I was there with a group of friends during St. Patrick's Day. I had never been to this place before but had so much fun. During SPD they had a few bands playing 70s music that were actually pretty good, along with some Irish bagpipers (with the sexy skirts and all) entertaining the crowd.?

They had a setting outside but was rainy, cold and miserable that day, I believe the staff went to great lengths to move everything inside. ?Two in my party ordered food and said it was good. As for me I only had beer that evening but surely Ill be coming back to try their lunch or dinner.

Dickie O Neil's is a great local bar! 2 for 1 burgers on Tuesday nights, All You Can Eat spaghetti and meatballs on Thursdays and lots of other great specials. Don't forget breakfast all day at a great price. Service has it's ups and downs but since it's a great neighborhood bar with lots of TV screens for sports and games you can easily occupy yourself while you wait. Karaoke on Friday. Give this place a chance.

Dickie O'Neal's is our favorite place to go when we are in Palm Springs during the winter months. ?We can always count on a consistently good meal, consistently good service, and a friendly atmosphere for a very reasonable price. We prefer going to a place where everybody knows our name.

We also like the Irish items on the menu - fish & chips, shepherd's pie, the best bangers & mash this side of the emerald isle, and not to be forgotten the best corned beef and cabbage in the valley. ?We also enjoy the turkey dinner and all the trimmings on Sunday evening, the 2 for 1 burgers on Tuesday, and the bottomless spaghetti and meatballs on Thursday.

Breakfast at Dickie's is great too bottomless mimosas. Michael and his staff always make us (and our guests) feel welcome and we look forward to our return next January.

I like Dickie O'Neals. I used to go to Sherman's a lot, and was looking for an alternative, and I found a good one. The food is good, and reasonably priced. Drinks and service were good. Parking was good (although they sprayed water all over my newly washed car while cleaning the drive. errrrrrr!!!) But, other than that I really like breakfast there on the weekends. Not too crowded either for a sports pub. We'll be back.

Ate at Dickie's about a week ago. ?On Tuesday they have 2-4-1 burgers with your choice of side. ?Also can get a veggie burger for free. ?You get a ton of great tasting food for $7.95 for two burgers and fries or onion rings (which are great) is a great deal. ?Definitely check it out. ?I'll be going there again so look for further reviews from this great little place.

I highly recommend the breakfast service at Dickie O'Neal's Irish Pub, Friendly staff, and fast low key service. No rush for table turnover like some others. Take your time. I like their three egg omelet with sliced avocado. ?Getting hungry yet? Fans of NTN Trivia will find "The Game" is on. Large parking lot, street parking, and convenient access along North Palm Canyon Drive.

TIP: Don't try to make a left turn across the double yellow line. ?Just go to the next intersection and u-turn south on Palm Cyn. Then an easy right turn into the parking lot entrance, or just park on Palm Cyn.

We stopped in after driving from San Francisco and really enjoyed the burgers especially when we found out it was two for one price. ?They were friendly ?and came over to our table to talk to us. ?I think because John is from Ireland too, but we enjoyed ourselves.

We actually went back for breakfast and it was good too. We will definately stop there again on our way to see family in Arizona.? We enjoy the updates and emails too.? We give it our thumbs up and the 5 stars.

We receive great service, and the food is good. ?The prices are more than reasonable and we love the atmosphere. ?They pour a full glass of wine, how novel! ?Dickie's is very close to where we live, so it is one of our favorite haunts. Have been going by Dickie O'Neal's Irish Pub Restaurant for months but never stopped.....went there twice this past weekend and it was great....extensive menu, good food, great prices and friendly staff. The homemade turkey dinner on sunday was delicious. Try it out. You'll like it!

It took us less than 30 minutes to walk (briskly) from the Hyatt Regency Suites ..... and we benefited by getting a great meal for a very reasonable price. The big plus - Guinness on tap for $4 !? We saw Dickie's on the drive in toward the Hyatt and we forget to check the distance, so we were pleased that it wasn't 3 miles away ! The walk whetted our appetites, but still - we were sure that the meal would be too big to eat alone. We were right .....

We had the full rack of ribs, served with a generous portion of french fries, onion rings and cole slaw. The french fries were unremarkable and probably they didn't benefit from lying underneath the ribs. The onion rings were outstanding - I had a few at the start of the meal and a few at the end. They were crisp from start to finish and were not overly greasy. The cole slaw was a bit spicy (maybe horseradish ?) but not unpleasantly so. It gave it a nice kick.Lucky for us, we got there early (Friday night), as there were two large parties going on. The place was filled with locals for happy hour and dinner, and the staff was also preparing for karaoke night.

If you want a good meal at a reasonable price, get in a big of exercise to whet your appetite and work off the dinner, and did I mention, Guinness on tap for $4 ????, then Dickie O'Neal's is your place. If you just want to spend a lot of money and save your feet, stay downtown. There are plenty of places to do that !

Dickie O'Neal's Irish Pub is a great place to watch the game with your friends. The food was delicious. You can order off the full menu or off the special NFL football menu. Every game is played on all of its 12 TVs and the excitement is intense.? We decided to have breakfast and catch the first game. Very comfortable and the staff is truly professional, yet down to earth and fun.? I love this Irish Pub!

Very friendly (the owners took the time to come over and talk to us like we were friends), the food was excellent, generous portions, very clean, and affordable.? We weren't looking for a night club, just somewhere to be together. We were also back for breakfast which was very authentic. The bangers and mash were delicious, and we even tried the macaroni and cheese (which I hear is a Irish grandmother's secret recipe).? Visitors unite! Dickie O'Neal's is a safe haven! Whatever you think of the latest round of Chromebooks, school districts have clearly latched on to existing models. Over 500 school districts across Europe and the US are currently deploying the Google-powered laptops for learning the web way. Specialized web app packs and that rare leasing model are already keeping the material relevant and the hardware evergreen, but new certification for US ready-for-college criteria will go a long way towards making sure principals everywhere take a shine to Chrome OS in the future. That still leaves a lot of schools going the more traditional Mac or Windows PC route, with the occasional tablet strategy thrown in; regardless, we're sure Google doesn't mind taking any noticeable chunk of the market in a relatively brief period of time. We'll see if there's more reasons for Mountain View to get excited in a few days.

Understanding the Journal Impact Factor Part Two

Despite its many faults (see?part I), the Journal Impact Factor (JIF) is considered an influential index to a journal?s quality, and publishing in high-impact journals is essential to a researcher?s academic career.

Reminder: to calculate, for example, the 2010 JIF for a journal -

JIF= (2010 citations to 2009+2008 articles)/(no. of ?citable? articles published in 2008+2009)

The JIF did start as a tool helping librarians with subscription decisions, but its influence among authors, readers and editors has increased with time, and so has the scientific community?s interest. More and more papers have been written about the JIF throughout the last thirty years (graph 1).

Different field, different JIF

JIFs vary widely with the discipline. Journals dealing specialized or applied areas will have, on average, lower JIFs than those in pure or fundamental areas (graph 2). The average number of article references correlates with the citation impact of each field. Biochemistry articles, for example, have twice as much citation than mathematics articles.

JIFs also correlate with the number of authors per article, because the more authors an article has, the better the chances it?ll be self-cited. A study of Lancet articles found that even among articles published in the same journal, the most-cited articles had on average 3-5 times more authors than the least cited articles. So the social sciences, with about two authors per article, have less citation impact than fundamental life sciences, with more than four authors per article. The arts and humanities journals? JIFs are quite pitiful, because scholars in those fields rarely cited journal articles. The highest 2010 JIF in the JCR Cultural Studies category is 0.867.

TR recently launched a new product, the Book Citation Index. It currently covers 30,000 books from publication year 2005 onwards, and 10,000 new books will be added every year. Of course, that means that all the book citations prior to 2005 will still go unnoticed, but at least it?s better than nothing, and we might finally see a bit of humanities coverage.

When researchers publish in high-impact journals, even if their own articles are rarely cited, or not at all, they still enjoy the journals? prestige. It also works the other way around: a well-cited article can make JIFs considerably higher, especially in small journals. ?A study done on three biochemistry journals showed that 50% of the journals citations came from the 15% top-cited articles, and that the top half of the most cited articles were cited ten times as much as the lower half. Articles can be published in the same journal and have a completely different scientific impact (as measured by citations, of course).

The two-year citation window

The regular citation window of the JIF is two years. It favors fast-moving fields, where articles are cited quickly but also obsolesce fast. Journals in slower-moving fields, where citations don?t accumulate quite as fast, will have higher JIFs in longer time frames. ?If we look at the graph of the average JIFs for 200 chemistry journals (graph 3) we see that the five-year JIF curve is smoother, while the two-year curve varies widely. It means that journals with different two-year JIFs might have more similar impact over time.

?Letters? journals, where articles are usually short, tend to receive more citations within the two-year window. On the other hand, the accumulation of citations for review journals is slower. However, reviews tend to get so many citations that even the fraction of citations they get in the short citation window give review journals relatively high JIFs. Campanario (2011) compared two-year and five-year JIFs and found that a longer citation window increased the JIFs of about 72% of the journals, but lowered them for about 27%.

Self-citations

The debate about whether journal self-citations should be included in calculations of the JIF is an old one. Currently, self-citations aren?t excluded from JIFs, but journals with an exceedingly high level of self -citations are sometimes ?punished? and excluded from the index for a while. The rate of journal self-citations changes according to discipline and journal, but in general, it?s about 20%. If we?re talking about a specialized journal, the number might be higher. This is the reason why editors sometimes write editorials with dozens of self-citations?

In conclusion

The JIF is a crude index of a journal?s impact (I won?t go as far as to say quality). It was devised in a certain time in history for certain uses and, well, might have been blown out of proportions. Corrections have been suggested throughout the years, but most of them stayed in bibliometric journals rather than influence the general scientific community. Many researchers see the JIF as a definitive measure, but ?people have to remember that it?s is only one tool in the box of science measuring indices, and a journal JIF says very little of a single article, or researcher, quality. As Seglen (1997) said ?Evaluating scientific quality is a notoriously difficult problem which has no standard solution.?
